Approved: shed three feet from side line, not five, on sloped Nampa lot
The city approved a variance for a 200-square-foot shed already built about three feet from the side property line, where five feet is required, because the sloped yard made that the most level spot. Approval requires an encroachment agreement and a building permit for the shed's electrical work within six months,…

The owners of 529 Noble Fir Ct in Nampa already built a 10-by-20-foot shed about 3 feet from the side property line, where the city requires 5 feet, and asked for a variance to keep it there. Staff said the sloped yard made this the most level spot on the lot, and that moving the shed would require costly excavation. The variance was approved with conditions requiring an encroachment agreement and a building permit for the shed and its electrical work, both within six months.
Due to the slope of the ground in our backyard, we request a reduction in the side setback from the five-foot requirement (as set forth in Code for the RS6 zone) to three feet in order to place our shed on the flattest and most level ground area.
